On February 13, 2003 REO launched a $100 million dollar Class Action lawsuit in the Ontario Superior Court of Justice on behalf of patients of Toronto doctor Sheldon Victor Pollack. The representative plaintiff in this action is Anna Barbiero of the City of Toronto. Dr. Pollack, a dermatologist by training, used Liquid Silicone to smooth his patients’ fine lines and wrinkles, despite the fact that this product was never approved for use in humans or animals by Health Canada. Ms. Barbiero alleges in her statement of claim that she suffered adverse health effects after Dr. Pollack injected her with Liquid Silicone. The statement of claim alleges that Dr. Pollack knowingly injected the class members with an untested, unsanctioned and unlabelled product of unknown composition, which he had obtained through an unauthorized and highly suspect source. On December 11, 2003, this action was certified as a class proceeding by Justice Cullity of the Ontario Superior Court of Justice. REO is currently preparing for a trial of this action and will post the trial date as soon as one is set by the Court.
